By using the Services - whether by browsing, submitting a form, requesting a quote, shceduling an appointment, clicking "Next/Continue," or otherwise interacting with the Services - you agree to these Terms. If you do not agree, do not use the Services.
These Terms apply across all insurance products and services we may discuss or offer, including (as applicable) life, health, Medicare, disability, auto, home, and related products (availability varies by state and carrier).

We do not provide legal, tax, or medical advice. Any information on the Services is for general informational purposes and may not apply to your specific situation.
4) QUOTES, COVERAGE, AND INSURANCE PRODUCTS
Any quote, estimate, or rate indication provided through the Services is not guarantee of coverage or final pricing. Final rates, eligibility, coverage, and policy terms are determined by the issuing insurance carrier and may require additional information, verification, underwriting, medical records/exams (if applicable), or other steps.
Policy terms control. If a policy is issued, your rights and responsibilities will be governed by the policy and carrier documents you receive.
5) STATE AVAILABILITY AND LICENSING
Insurance products may be offered only in states where the appropriate party is licensed and where the product is approved/available. Not all products are available in all states.
6) YOUR RESPONSIBILITIES AND ACCURACY OF INFORMATION
You agree to provide accurate, complete information when using the Services. You understand that inaccurate or incomplete information may affect quotes, eligibility, or coverage decisions and may result in delays or denial of coverage.
7) ACCOUNTS, SCHEDULING, AND COMMUNICATIONS
Some parts of the Services may allow you to schedule an appointment, interact with chat tools, or communicate with us. You are responsible for maintaining the confidentiality of any account credentials you create (if applicable) and for all activity that occurs under your account.
We may send confirmations, reminders, and service-related messages (email/SMS/phone) related to your requests.
8) CONSENT TO DO BUSINESS ELECTRONICALLY (E-SIGN)

11) INTELLECTUAL PROPERTY
The Services and all content on them (text, graphics, logos, designs, templates, and software) are owned by or licensed to the Company and are protected by intellectual property laws.
You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services or content unless we provide written permission.

The Services may include links to third-party sites or services (such as scheduling tools, chat tools, analytics, payment providers, or carrier/partner sites). We do not control third-party sites and are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms and policies.
13) DISCLAIMERS
the services are provided "as is" and "as available." to the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that nay quote, rate, or coverage outcome will be available or approved.
14) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY (AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SERVICE PROVIDERS, OR PARTNERS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED $500 OR THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

15) INDEMNIFICATION
You agree to indemnify and hold harmless the Company and its affiliates, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any law or third-party rights.
16) GOVERNING LAW
These Terms are governed by the laws of New York, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.
17) DISPUTE RESOLUTION AND ARBITRATION
IMPORTANT: This section affects your legal rights, including your right to sue in court and have a jury trial.
A. Informal Resolution First

B. Binding Arbitration
Except for claims that qualify for small claims court or claims seeking injunctive relief for intellectual property misuse, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis.
C. Class Action Waiver
You agree that disputes will be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
D. 30-Day Opt-Out
You may opt out of arbitration by sending written notice to 123 Insure Way, NY 11021 within 30 days of your first use of the Services, stating your name and that you wish to opt out of arbitration.
18) CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Last Updated" date reflects the latest revision. Your continued use of the Services after changes are posted means you accept the updated terms.
